Terms and Conditions

Who you are buying from
This shop is operated by Chump Inc., an Ontario corporation, trading as Gary Taxali Fine Art & Illustration, of 267 Kristin Grove, Mississauga, Ontario L5A 3E7, Canada. You can reach us at gary@garytaxali.com. In these terms, "we" and "us" mean Chump Inc., and "you" means the person placing the order.
Buying from us
You must be able to enter a binding contract to order from us, and if you are under the age of majority where you live you may only order with the involvement of a parent or guardian. Your order is an offer to buy, and a contract forms only when we send you an order confirmation. We may decline an order before that point, for reasons including an item being sold out, a pricing or description error, a payment we cannot verify, or a delivery address we cannot ship to. If we decline your order after you have paid, we refund you in full.
Products
We sell original artwork, signed and numbered limited edition prints, open edition prints, books, apparel, phone cases, toys and other goods. We describe every item as accurately as we can, but colours vary between screens and printing runs, and paper and fabric stock can change, so small variations are normal and are not defects. Original artwork and hand-finished pieces are unique, and the item you receive will differ slightly from the photograph.
Limited editions
Where an item is sold as a limited edition we state the edition size on the product page, and each piece is signed and numbered by the artist. We do not reprint a sold-out limited edition at the same size and specification.
Pre-orders
Some items are sold before they exist, and a pre-order product page says so and gives an expected shipping window. That window is an estimate rather than a promise, because printing and production dates move, and we will tell you if the date changes materially. We take payment when you place a pre-order rather than when the item ships, and you may cancel a pre-order for a full refund at any time before it ships.
Personalisation
Where we offer a personalised inscription you may request one in the order notes at checkout, and requests should be brief because the space is limited. We may decline to write something that is offensive, defamatory, or infringes someone else's rights, and if we decline we will contact you before we ship. A personalised item cannot be returned unless it arrives damaged or is not what you ordered.
Prices and taxes
All prices are in US dollars unless the product page says otherwise, and they exclude shipping, which is calculated at checkout. Prices also exclude import duties, customs charges and local taxes, so if you are outside Canada your country may charge these when the parcel arrives. Those charges are your responsibility, we cannot tell you in advance what they will be, and we do not mark parcels as gifts or understate their value. We may change prices at any time, though a change does not affect an order we have already confirmed, and if an item is listed at an obviously incorrect price we may cancel the order and refund you rather than honour the error.
Payment
We accept the payment methods shown at checkout, payments are processed by Stripe and PayPal, and we do not receive or store your full card number. By paying you confirm you are entitled to use the payment method, and if a payment is reversed or charged back without cause we may recover what we are owed and may decline future orders from you.
Shipping and delivery
Our Shipping and Returns policy forms part of these terms and covers delivery times, carriers, tracking, lost parcels and damage in transit, and risk in the goods passes to you on delivery. Some items are printed and shipped by a third party fulfilment partner on our behalf, and where that applies the delivery times and packaging are theirs, but your contract remains with us and you deal with us.
Returns and refunds
Our Shipping and Returns policy sets out when you can return an item and how to do it. Nothing in these terms removes any right you have under Ontario's Consumer Protection Act, 2002 or other consumer protection law that applies to you.
Intellectual property
Every artwork, illustration, image, design, text and other work on this site is owned by Gary Taxali or by Chump Inc., or used under licence, and is protected by copyright and, where applicable, trade mark law and moral rights. Buying a physical item does not transfer any copyright to you: you own the object, and we keep every right in the artwork it carries. Unless we agree otherwise in writing you may not reproduce, scan, photograph for reproduction, copy or redistribute the artwork; make derivative works from it; use it commercially, including in advertising, merchandise, packaging or branding; use it to promote any product, service, organisation, campaign or cause; or remove or alter any signature, edition number, copyright notice or authenticity marking. You may photograph an item you own for ordinary personal purposes, including showing it in your home on social media, provided you credit Gary Taxali and do not imply he endorses you or anything you sell. The artist asserts his moral rights, including the right to be identified as the author of the work and the right to object to any derogatory treatment of it.
Artificial intelligence and automated access
Gary Taxali and Chump Inc. expressly reserve all rights in the works on this site for the purposes of text and data mining, machine learning and artificial intelligence training, and this reservation is made for the purposes of Article 4(3) of Directive (EU) 2019/790 and any equivalent provision in any other jurisdiction. You may not use any content from this site, or any work you buy from us, to train, fine-tune, develop, evaluate, benchmark or ground any machine learning or artificial intelligence system, whether commercial or not, and you may not use it to generate imagery in the style of, or attributed to, Gary Taxali. You may not scrape, harvest, crawl, index or bulk download this site or its images for a dataset or corpus, whether directly or through a third party, an intermediary, or a commercially available dataset. Access to this site does not grant any licence for these purposes, and no such licence should be inferred from the absence of a technical restriction.
Resale and use of this site
You may not buy from us for the purpose of commercial resale, and we may cancel orders that appear to be placed for resale. You may not interfere with the site, attempt to gain unauthorised access to it, scrape it in bulk, place fraudulent or automated orders, or use it in a way that damages it or disrupts other customers, and we may suspend or refuse access if you do.
Third party links and availability
This site links to other sites we do not control, including social platforms and our fulfilment and payment providers, and we are not responsible for their content or their practices. We try to keep the site available, but we do not promise it will be uninterrupted or error free, and we may change, suspend or withdraw any part of it without notice.
Our responsibility to you
We stand behind what we sell, so if an item arrives damaged, faulty, or is not what you ordered, tell us and we will put it right under our Shipping and Returns policy. Beyond that, and to the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, or loss arising from delay in delivery, and where we are liable our total liability for any order is limited to the amount you paid for that order. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing in these terms affects your statutory rights as a consumer.
Your responsibility to us
If you breach the intellectual property or artificial intelligence sections above, you are responsible for the loss that causes us, including reasonable legal costs of enforcing our rights.
Privacy and changes to these terms
Our Privacy Policy explains what personal information we collect and what we do with it. We may update these terms, the version that applies to your order is the version published when you placed it, and the last updated date appears at the top.
Governing law
These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there, and the courts of Ontario have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of the place where you live.
